General: Broadband Throttling

My ISP have made me very angry indeed. (not sure how I stand legally if I'm wrong about this so not going to say which one) I've just upgraded from a 1mb to 4 mb service. My router under the old service was reporting being connected at around 2200kbps and the new service at around 7600kbps.

It was last night I first noticed the faster connection had been activated so I immediately started up Miro to download a video. I was shocked to find it was only downloading at around 40kbps compared to around 150kbps on the old connection. I got called out to the pub at this point so couldn't investigate much more. I got back at around 10:15 hoping things had speeded up a bit. then spent the next 45 mins downloading things from different sources to check it was not just one or two sites. Everything was very slow.

Then just before 11 pm something magical happened and I could download at speeds approaching 400kbps. Having done a little googling I'm pretty sure I'm being throttled at peak times and would have been better off leaving things alone. Tonight will tell.

I've just agreed to another 12 month contract for broadband and phone and I might as well be on dialup right now. It's made all the more difficult by the fact that it's all in my mum's name so they won't talk to me if she's not around.

What would you do?

Edit - It appears I have jumped to conclusions too quickly. The e-mail from the ISP asks that I allow 10 days for the service to settle before complaining.

I'm not sure. I thought it had, until last night when it went off completely for about an hour and I was getting a message from BT wholesale in my browser. Right now I'm downloading a video at around 50kbps. It's still definitely faster after 11pm. I've had 750kbps at times.

I think I'll give it another week or so.
